AI Legal Research in India: How It Works and Where It Fails

AI legal research in India means a cited search of judgments and statutes. This guide covers the workflow, the sources, and the checks before you rely on it.

AI legal research in India is a search of judgments and statutes that shows you the passage behind the point. A model's memory of "what the courts have held" is not that search. If the answer does not give you a judgment or a section you can open, you do not have research yet.

This guide is for advocates, juniors and chamber clerks who write notes, and for law students who will be asked for "three cases on this" before lunch. It sets out which Indian source does which job, a workflow from issue to note, and the checks that sit between a draft answer and anything you would put in a filing.

Key takeaways

  • AI legal research in India is retrieval from Indian sources, plus a citation you can open. It is not a model's recollection.
  • Indian Kanoon, India Code, court websites and eCourts answer different questions. Mixing them up produces confident, useless notes.
  • A usable citation names the court and the year and points at the passage. A case name with no passage is not ready to file.
  • The junior's note separates what the court held from what you want to argue. The model will blur that line unless you stop it.
  • Scafffold can search Indian Kanoon and look up a CNR. You still read the source before you rely on it.

AI legal research in India means the tool looks up Indian judgments and statute text, then answers from what it found. The answer is checkable when you can open the same passage and see the words the note relies on.

A general chatbot does something else. It writes the sort of paragraph that usually follows a question like yours, drawn from patterns in its training. That paragraph can be fluent and still name a case that does not exist, or a real case for a proposition the court did not decide. Fluency is not a source.

Three different jobs get called "research" in a chamber. They are not interchangeable.

JobWhat you are askingWhere the answer has to come fromWhat a wrong source looks like
StatuteWhat does this section say, today? The bare act on India CodeA paraphrase with no section, or a repealed code
PrecedentWhat has a court held on facts like these? The judgment, found through Indian Kanoon and then readA headnote, a blog, or a case name you cannot open
This fileWhat is the status, the last order, the next date?eCourts, by CNR, or the Supreme Court case-status pageA reported judgment used as if it were tomorrow's board

The rest of this guide keeps those three jobs apart. A later post, [LINK: ecourts-case-status-guide], is the full guide to case status. This one is about precedent, and about not confusing it with the docket.

How is a model's memory different from a search of the sources?#

A language model predicts the next word. It is very good at the shape of a legal sentence. It is not a library, and it does not "look up" anything unless a search is actually run and the text is put in front of it.

That distinction matters more in India than in a jurisdiction with one national set of reports and a slow statute book. A junior in a High Court practice needs the Supreme Court where the point is settled, and that High Court where it is not. Tribunal orders, amendments, and the difference between a holding and a direction all live in the text. None of that is stored in the model as a record you can audit. It is reconstructed.

Two consequences follow.

First, an answer with no search behind it will often look like the leading case. The name will be plausible. The citation will have the right rhythm: a year, a volume, a page. The rhythm is what the model learned. The page may not exist. The post on [LINK: ai-fake-case-citations] is the verification routine for that failure. This guide does not catalogue particular incidents. If you cannot open the judgment, the incident does not matter. The citation is unusable.

Second, even a real case can be attached to the wrong sentence. The model has seen the case name next to a topic so often that it offers the name whenever the topic appears. That is memory, not reading. The check is the same: open the judgment and find the sentence, or do not cite it.

Retrieval changes the shape of the work. The tool searches a database, receives judgments, and is then asked to answer from those judgments. You can see the query and the text. You can disagree with the summary because you have the same page. That is the only form of AI legal research worth handing to a senior.

Retrieval does not remove the need to frame the issue. A search for "contract" returns noise. A search built from the relief, the court and the section returns something a junior can read. The post on [LINK: indian-kanoon-search-tips] covers operators and filters. You do not need the operator manual to start. You need a sentence a senior would recognise as the question.

Why does a citation you can open change the work?#

A citation is an address. It lets the next person stand where you stood and see the words. In Indian practice that next person is often the senior who will sign the note, or the court.

A citation you can use has four parts:

  1. The case name, the court and the year.
  2. A reporter citation or a neutral citation, if you have one from the judgment itself, not from memory.
  3. The proposition, in your words, kept narrower than the case.
  4. The passage: a short quote or a pinpoint you have actually seen.

Indian Kanoon is the search layer most juniors already use. It is not an official law report. For a filing, confirm the text against the court site or an official report. The Supreme Court publishes judgments and a case-status search on its own site. India Code is the place for the bare act. If Indian Kanoon and India Code disagree on a section, follow India Code and record the disagreement in the note. [VERIFY: where an official report and Indian Kanoon differ on a particular judgment, which text the court expects in that forum.]

Headnotes are not the passage. A headnote is an editor's compression. It can be right and still omit the fact that made the holding inapplicable. Read the court's own words. The post on [LINK: how-to-read-a-judgment] is the method for finding the ratio, the obiter and the directions. Until that post is up, use this test: if you deleted the headnote, could you still point to a paragraph in the judgment for the sentence in your note? If not, the note is not finished.

Quotes stay short. A quote that runs for half a page usually means you have not decided which sentence does the work. One or two sentences, attributed, with the paragraph or page, is enough. Then paraphrase the rest in your own words so the senior can see what you think the court decided, as distinct from what it said along the way.

Do not treat a string of case names as research. Three names and no passages is a list of things to open. It can still be a useful list. It is not a note.

Which Indian sources should a research answer come from?#

Use the source that matches the question. As of 8 October 2026, these are the public starting points.

QuestionOpen thisWhat you getWhat you do not get
What does the section say?India CodeCentral Acts as published thereA commentary, or a guarantee that every state amendment is flagged in your note
Which judgments discuss this point?Indian KanoonSearch across Supreme Court, High Courts, tribunals and statutes, then the full textAn official reporter citation you can assume is courtroom-ready
What did the Supreme Court do in this matter?sci.gov.in case statusDiary number, case number and the court's own recordA ratio. Status is not a holding
What is the status of this district or High Court matter?eCourtsThe public portal. Case status for district courts and High Courts is reached from herePrecedent. An order on the docket is not a reported judgment you cite for a principle

The eCourts homepage, as fetched on 8 October 2026, also points readers to separate High Court and district services, and it displays an SMS option: text ECOURTS followed by the CNR to 9766899899. That is a public status channel. It is not a research database. [VERIFY: that the SMS number and the path from the eCourts homepage to district and High Court search are unchanged when you use them.]

A CNR is the 16-character case number record used on eCourts: four letters and then twelve digits. ABCD010000002026 is a made-up example of that shape. It is not a real case. Do not look it up. The post on [LINK: what-is-cnr-number] decodes the format. For this guide, the only point is that a CNR identifies a file. It does not identify a principle of law.

Official reporters still matter when the senior or the court wants a reported citation. Indian Kanoon will often show a citation string. Copy it only after you have seen it on the judgment or in the reporter, not because the model repeated it. [VERIFY: the current public entry point for the Supreme Court Reports search. The Supreme Court site links to an SCR search; confirm the URL before you rely on a bookmark.]

Paid databases have a place. Use one when you need a citator your senior trusts, or a reporter citation you cannot confirm on the court site. Do not use a paid database as an excuse to skip the judgment. The text is still the authority.

Statutes move. A section number from a commentary in 2019 may not be the section you should cite now. Open the Act on India Code on the day you write the note. For criminal work, the further problem is that the Indian Penal Code, 1860, the Code of Criminal Procedure, 1973 and the Indian Evidence Act, 1872 have been succeeded by the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023. [VERIFY: the commencement notification, and which code applies when the offence or the proceeding began before the change.] This guide does not map section numbers. If the question is criminal, write both the old and the new number only after you have checked a mapping a reviewer has signed, and say which proceeding you are in. A model that "still thinks in the IPC" will not do that for you.

How do you run a research note from issue to authority?#

The workflow below is the one a junior can run on paper, with Indian Kanoon in a browser. A tool can do the search step. It cannot skip the framing or the reading. The longer version of this sequence is [LINK: legal-research-workflow].

Example only. ABC Pvt Ltd has agreed to sell its shares in DEF Components Pvt Ltd to XYZ Industries Ltd. A junior in a Delhi chamber is asked for a note on whether a court can be asked to enforce that agreement. These names are invented. Nothing below is a holding.

  1. Write the issue in one sentence. Name the relief, the asset and the court you are in. "Can the buyer ask a civil court to enforce an agreement to sell shares in a private company?" is a research question. "Law on specific performance" is a topic. Topics produce piles. Questions produce notes.
  2. Open the statute before the cases. For this example the statute is the Specific Relief Act, 1963, on India Code. Read the sections on specific performance as they stand, including amendments. [VERIFY: the current text of the Specific Relief Act, 1963 after the 2018 amendment, and whether specific performance is available for an agreement to sell shares.] Do not let a case from before an amendment answer a question the statute has since changed.
  3. Search judgments in a set order. Start with the Supreme Court if you need a statement that binds the High Court. Then search the High Court you are in. Then other High Courts, labelled as persuasive. A usable query for the example is specific performance agreement to sell shares private company, with the court limited to the Supreme Court first. Add a date limit when the statute has changed. The post on [LINK: indian-kanoon-search-tips] is the filter guide.
  4. Read the judgment, not the snippet. The snippet got you there. The holding is in the judgment. Record the paragraph you would read aloud to the senior. If you cannot find one, the case does not support the point, however often its name appears next to the topic.
  5. Check later treatment. Indian Kanoon shows cases that cite the judgment. Open the ones that look like they narrow or doubt it, at least the Supreme Court ones and the ones from your High Court. A list of citing cases is a start, not a finished citator. If the senior wants a reported citator, use that as well and still read the later case.
  6. Separate the holding from the argument. Write two lines. Line one: what the court decided, tied to a fact that matters. Line two: how that fact compares with ABC Pvt Ltd's draft. If you only have line two, you have a submission, not research.
  7. Stop. Add a case only if it changes the proposition or shows that your court has gone another way. A note with twelve undigested names is harder to use than a note with three passages.

Here is the skeleton the junior fills in. It is a template, not a completed opinion.

FieldWhat to write in the example
IssueEnforcement of an agreement by ABC Pvt Ltd to sell shares in DEF Components Pvt Ltd to XYZ Industries Ltd
Statute openedSpecific Relief Act, 1963, with the section numbers copied from India Code on the day of the note
QuerySupreme Court, then Delhi High Court: specific performance, agreement to sell shares
AuthorityCase name, court, year, and the paragraph. Blank until you have opened it
Later treatmentOne line: followed, distinguished, or not checked yet
FitWhich fact in the draft matches the case, and which does not
Not in this noteNo advice to file or not to file. No case you have not opened

If the junior also has the suit's CNR, that is a second task. Look the file up for status, the last order and the next date. Put that in a different section of the note, labelled as the docket. Do not cite an interim order as if it were a Supreme Court holding on specific performance. Summarising an order has its own checks, covered in [LINK: summarise-court-order-ai].

Prompts, if you use them, belong after this skeleton exists. A prompt that says "give me the law on specific performance" invites a lecture. A prompt that says "from these three judgments only, what did the court hold about agreements to sell shares, and quote the paragraph" invites a draft you can check. A set of prompts, each with the check that goes with it, is [LINK: ai-prompts-for-lawyers].

Where does this fail, and what do you check before you rely on it?#

These are the failures that show up in Indian research notes. The left column is what you see. The right column is the check. None of these is fixed by asking the model to "be accurate".

What you seeWhat is wrongWhat you do
A case name and a citation you cannot openThe case may be invented, or the citation may be garbledSearch the exact name on Indian Kanoon and on the court site. If it is not there, drop it
A real case, and a proposition you cannot find in itThe name was associated with the topic, not readFind the paragraph or delete the case
A real passage from a case that has since been doubtedThe search returned the famous case and stoppedRead later Supreme Court and local High Court cases that cite it
A section from the IPC, the CrPC or the Evidence ActThe code in force for that proceeding may be the BNS, the BNSS or the BSAOpen India Code. [VERIFY: which code applies to this proceeding.] Do not guess
A pre-amendment case applied to a post-amendment sectionThe statute moved and the memory did notRead the section as it stands, then ask whether the case survives it
An eCourts status page used as authorityStatus, party names and a next date are not a ratioCite a judgment for the law. Use the CNR lookup only for the file
A headnote quoted as the courtAn editor wrote the headnoteQuote the judgment or do not quote
A long quote you cannot find on the pageThe quote was smoothed or inventedSearch the judgment for a distinctive phrase from the quote

The order of checks, every time:

  1. Does the case exist on Indian Kanoon or the court site?
  2. Do the court and the year match the citation in your note?
  3. Does the passage say what the note says, in words you can see?
  4. Does a later case from a court that binds you narrow it?
  5. Does the statute, opened today, still support the frame you put the case in?

If any step fails, the sentence does not go in the filing version of the note. It can stay in a "checked and rejected" line so the senior knows you saw it.

A general chatbot is a poor place to run this workflow, because nothing forces the search. The comparison, including confidentiality and stale codes, is [LINK: chatgpt-for-indian-lawyers]. The short version: a chatbot can help you think of search terms. It cannot be the source you cite.

What should the junior's note contain?#

Keep the note shorter than the research. A senior can use one page. A senior cannot use a paste of everything the search returned.

Use this order.

  • Issue. One sentence, with the relief and the court.
  • Statute. The Act, the year and the section, copied from India Code, with the date you opened it.
  • Holding. For each case you are willing to rely on: name, court, year, one sentence on the facts that mattered, and the paragraph. Italicise the party names. Link the judgment.
  • Later treatment. One line. "Not checked" is an acceptable line. Silence is not.
  • Fit and difference. How this brief matches, and the fact that might take it outside the case.
  • Docket, if you have a CNR. Status, last order, next date. Label it so nobody cites it as precedent.
  • Open points. What you did not check. This is the most useful paragraph in the note.

Do not write "the law is well settled" unless you have the passage and the later treatment. Do not write what the client should do. Explain the authorities. The person who signs the advice is the advocate, not the note.

Hand the senior the judgments as well as the note, or links that open. A note that cannot be checked in five minutes will not be trusted, however neat it looks.

Doing this with Scafffold#

Scafffold runs the search with you. It does not replace the read.

You put the pleadings and the correspondence in a project and ask in plain English. For precedent, Scafffold searches judgments and statutes through Indian Kanoon, and you can read the full text in the same conversation. The record of a judgment also lists cases it cites and later cases that cite it. Treat that list as a start, not a complete citator. When an answer uses a file you uploaded, it points to the page and the passage. Open that passage. Scafffold does not verify every citation in a draft.

For the live matter, look the case up by its CNR. You get status, hearing history and orders. That is the docket, not the law. Scafffold does not send a hearing alert.

You choose Claude, Gemini or GPT for that conversation. API keys you add are encrypted with AES-256-GCM before they are stored. The project stays private until you share it by email with a named colleague.

Create an account when you want to run a brief this way. The five checks above are the same if you never sign up.

FAQ

What is AI legal research in India?
It is a search of Indian judgments and statutes that shows the passage behind each point. A fluent paragraph from a model's memory is not research until you can open the source and read it.
Can I rely on an AI summary of a judgment?
Not on its own. Read the holding and the directions in the judgment. Check that any quote appears in the text, and that a later case has not narrowed it. A summary is a map, not the authority.
Is Indian Kanoon an official law report?
No. Indian Kanoon is a search tool for judgments and statutes. For a filing, confirm the text against the court website or an official report, and confirm the section on India Code.
How is eCourts different from case-law research?
eCourts shows the status, hearing history and orders of a particular case, looked up by CNR. Indian Kanoon is where you search published judgments for precedent. A case status page is not a holding.
What is the first check on a case an AI cites?
Open the judgment. Confirm the court, the year and the passage. If you cannot find the case, or the passage does not say what the note claims, do not use it.
